Terms & Conditions of Hire
Driving Licence Requirements
- Age Restrictions: Drivers must be aged between 23 and 75 years.
- Additional Checks for Young Drivers: Drivers aged 23 to 25 are subject to further verification and must have held a valid driving licence for a minimum of 24 months.
- Licence Duration:
- A UK driving licence must be held for a minimum of 12 months.
- A non-UK driving licence must be held for a minimum of 24 months.
- International Driving Permit: An International Driving Permit is required for holders of Indian driving licences and any licences featuring non-Latin numerals, or if the licence cannot be adequately translated.
- Disclosure of Points and Endorsements: All points and endorsements must be disclosed for review. Major convictions within the last five years will not be accepted.
Car Hire – Mileage Allowance
- Standard Mileage Allowance: All vehicles have a mileage allowance of 150 miles per day, with an excess mileage charge of £0.30 per mile.
- Unlimited Mileage Options: Unlimited mileage is available for all vehicles when either the Full Cover or Full Cover + Payment Protection plans are selected.
- Business/Long-Term Use: Vehicles hired for business or long-term use under the customer’s own insurance will have a mileage allowance of 500 miles per week, with an excess mileage charge of £0.30 per mile.
Van Hire – Mileage Allowance
- Daily Use Mileage Allowance: All vans hired for daily use under our insurance have a mileage allowance of 150 miles per day, with an excess mileage charge of £0.30 per mile.
- Business/Long-Term Use: Vans hired for business or long-term use under the customer’s own insurance will have a mileage allowance of 500 miles per week, with an excess mileage charge of £0.30 per mile.
Liability for Charges
The hirer accepts full responsibility for all charges incurred as a result of overhead damage or charges arising from misuse, regardless of any deposits or selected payment protection plans.

- Definitions
For the purposes of these Conditions:
- Accessories – Spare wheel, tools and other items supplied with the Vehicle, including replacements.
- Current Tariff – The Trader’s tariff of charges at the start of the Rental Period.
- Driver – The Hirer and/or any person named overleaf or otherwise approved by the Trader to drive the Vehicle.
- Excess Amount – The excess fee specified overleaf.
- Excess Waiver Fee – A fee calculated under the Current Tariff which limits the Hirer’s liability for the Excess Amount.
- Hirer – The person named in the rental agreement.
- Insurance Policy – The Trader’s insurance policy for the Vehicle, available for inspection at the rental location.
- Personal Accident, Personal Effects & Goods in Transit Insurance Fees – Fees payable under the Current Tariff providing the cover described in the Insurance Policy.
- Refuelling Charge – A surcharge added to the cost of fuel required to top up the Vehicle on return, calculated under the Current Tariff.
- Rental Charges – Charges for the Vehicle hire during the Rental Period, calculated under the Current Tariff.
- Rental Period – The period beginning at the start of hire (as stated overleaf) and ending when the Vehicle is returned to the Trader’s physical custody.
- Vehicle – The vehicle described overleaf, including any replacement vehicle.
2. Trader’s Responsibilities
2.1 The Trader confirms it has the right to transfer possession of the Vehicle for the Rental Period. 2.2 The Vehicle will substantially conform to its specification, be of satisfactory quality, and be fit for any purpose represented by the Trader.
3. Hirer’s Responsibilities
The Hirer acknowledges that:
3.1 The Vehicle remains the property of the Trader at all times. 3.2 The Vehicle and Accessories must be returned to the specified location on or before the due date. 3.3 The Hirer has inspected the Vehicle and is satisfied with its condition, subject to any noted exceptions. 3.4 Except where caused by the Trader, the Trader is not liable for injury, loss or damage arising from use of the Vehicle, nor for indirect or unforeseeable losses. 3.5 The Trader is not responsible for defects or mechanical failures not arising from breach of warranty or failure to exercise reasonable care.
4. Care and Security of the Vehicle
The Driver must retain possession of the Vehicle and Accessories at all times, must not permit third‑party possession, and must keep the Vehicle adequately protected and secured when not in use.
5. Prohibited Use
The Vehicle must not be used:
- 5.1 For hire or reward.
- 5.2 For racing, rallying, speed testing, tuition, or towing.
- 5.3 In any way that may invalidate the Insurance Policy.
- 5.4 For illegal purposes or in breach of legislation.
- 5.5 By any person who:
- Is not licensed to drive the Vehicle.
- Is under 21 or over 74 years of age.
- Is under the influence of drink or drugs.
- Has provided false personal details.
- Has not been approved by the Trader.
- Has undisclosed motoring convictions.
- 5.6 Outside England, Wales or Scotland without written consent.
6. Charges Payable by the Hirer
The Hirer must pay:
- 6.1 Rental Charges.
- 6.2 Any Excess Waiver Fee, insurance fees, and Refuelling Charge.
- 6.3 The Excess Amount for each incident involving damage or loss (unless caused by the Trader).
- 6.4 All fines, penalties, charges and related costs incurred during the Rental Period (unless caused by the Trader).
- 6.5 Any applicable taxes.
7. Liability for Loss or Damage
The Hirer is responsible for all losses suffered by the Trader due to damage, fire or theft of the Vehicle or Accessories during the Rental Period, including loss of rental income, unless caused by the Trader.
- 7.1. Customer is liable for any overhead damage and/or costs resulting from misfuelling vehicle.
8. Insurance and Operational Obligations
The Hirer and any Driver must:
- 8.1 Comply with the Insurance Policy terms.
- 8.2 Report any loss, damage or developing fault immediately.
- 8.3 Permit all reasonable actions required for repair or enforcement of rights.
- 8.4 Bear losses arising from breach of these Conditions.
- 8.5 Ensure payload and axle weight limits are not exceeded.
- 8.6 Manage loading and unloading of the Vehicle.
- 8.7 Hold any required operator’s licence.
9. Repairs and Property
- 9.1 All repairs must be authorised by IVH Ltd.
- 9.2 Claims for loss or damage to property stored in the Vehicle are excluded unless caused by the Trader’s negligence. Optional insurance may be purchased.
10. Excess Waiver
Payment of the Excess Waiver Fee limits liability to the Non‑Waivable Excess. However, the Hirer remains liable for any Excess Amount arising from negligent or wilful conduct.
11. Rental Period Limit
The Rental Period cannot be extended without written authorisation and must not exceed 89 days.
12. Licence Requirements
A valid HGV licence is required for Vehicles over 7.5 tonnes gross weight.
13. Consumer Rights (Consumer Hirers Only)
If the Vehicle does not meet the standards required under the Consumer Rights Act 2015, the consumer must notify the Trader within 30 days and return the Vehicle at their own cost. The consumer may:
- 13.1 Reject the Vehicle (“short‑term right to reject”).
- 13.2 Allow the Trader to repair or replace the Vehicle.
- 13.3 If repair or replacement is unsatisfactory, reject the Vehicle (“final right to reject”) or receive a refund for the unused portion of the hire.
14. Non‑Compliance
Failure to comply with these Conditions requires immediate return of the Vehicle and payment of any losses recoverable at law. If the Vehicle is not returned, the Trader may repossess it and recover associated costs.
15. Variations
Any amendments to these Conditions must be agreed in writing.
16. Trader’s Liability
Nothing in these Conditions excludes or restricts the Trader’s liability for death or personal injury caused by negligence, or any other liability that cannot be excluded by law.
Any customer taking vehicles on a weekly basis must provide weekly updates on their mileage.
These Terms and Conditions form part of the Rental Agreement.
